Deliveryman Terms of Service

Terms governing your use of the Winngs Partner App and your service as an independent contractor.

Effective Date: March 1, 2026

By registering as a Delivery Partner with Winngs, you agree to the following terms and conditions. These terms govern your use of the Winngs Partner App and your service as an independent contractor.

IMPORTANT: YOU ARE AN INDEPENDENT CONTRACTOR, NOT AN EMPLOYEE OF WINNGS.

1. Onboarding & Documentation

Verification:

You must provide a valid Aadhaar Card, PAN Card, Driving License (DL), and Vehicle Registration (RC).

Background Checks:

You consent to background and criminal record verification before activation.

Bank Account:

You must provide valid bank details in your own name for payout processing.

2. Service Standards

Flexibility:

You have the freedom to accept or decline any delivery request sent via the app.

Professionalism:

You agree to deliver orders promptly, maintain food hygiene standards, and interact professionally with customers and restaurant staff.

COD Handling:

For Cash on Delivery (COD) orders, you are responsible for collecting the exact amount and depositing it into the Winngs account as per the app instructions.

3. Earnings & Payouts

Fee Structure:

You will earn a base fee per successful delivery plus applicable distance incentives and surge bonuses.

Weekly Payouts:

Earnings are calculated on a weekly basis and transferred to your registered bank account as per Winngs' payout cycle. In case a delivery partner collects Cash on Delivery (COD) payments from customers, the collected amount must be settled with Winngs according to the platform guidelines. If any COD amount remains unsettled, Winngs reserves the right to adjust or deduct the outstanding amount from the delivery partner's weekly payout or future earnings until the full amount is cleared.

Taxes:

You are responsible for any personal income tax filing. Winngs may deduct TDS as per Government of India regulations.

4. Partner Responsibilities

Compliance:

You must follow all traffic laws and maintain a valid vehicle insurance policy at all times.

Integrity:

Tampering with food packages or opening sealed containers will result in immediate permanent deactivation.

Reporting:

Any accidents, delays, or customer disputes must be reported immediately via the "Help" section of the app.

5. Termination of Agreement

Performance:

Consistent low ratings (below 4.0) or a high order cancellation rate may lead to account suspension.

Fraud:

Any fraudulent activity, such as using fake GPS locations or creating multiple accounts, will lead to immediate termination and legal action.

Right to Disconnect:

Either party may terminate this relationship at any time by providing notice via the app.
